HYUNDAI OPEN ‘BEAT A PRO’ TERMS AND CONDITIONS

1. The following terms and conditions apply solely to the Hyundai Open Beat the Pro Challenge (“the Competition”) and the participation therein, offered by Hyundai Automotive South Africa (Pty) Ltd (“Hyundai”) in association with the Hyundai Open.
2. By entering the Competition, you are deemed to have read and consented to these terms and conditions and agree to be bound hereto. Information regarding the Competition that is published on authorised advertising material will also form part of these terms and conditions of the Competition.
3. Hyundai may in its sole discretion amend these terms and conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised terms and conditions on www.handicaps.co.za.
4. The Competition is organised by Hyundai Automotive South Africa (Pty) Limited, Registration Number: 1999/015934/07 and/or its agencies, if any, and Handicaps Network Africa (Pty) Ltd (“the Organisers”).
5. This Competition will run on 23 February 2025, which date is subject to change in the Organisers’ sole discretion and for whatsoever reason.

 

WHO CAN ENTER?

6. In order to participate and be eligible for the prize, participants must (“Participants”/”you”/”your”):

6.1. Be an amateur golfer;
6.2. Have a valid driver’s license;
6.3. Be 18 years or older;
6.4. Be a South African citizen or permanent resident in the Republic of South Africa (“RSA”);
6.5. Have a valid identity document; and
6.6. Reside in South Africa at the time of the winner selection and/or announcement.

7. Participants may not enter or receive a prize if they are directors, members, partners, employees, agents of or consultants of the Organisers, their subsidiaries, holding companies, divisions and/or associated companies or of the advertising or promotion agencies or any other person who directly or indirectly controls or is controlled by the Organisers, or their spouses, life partners, immediate family members or business partners.
8. By entering this Competition, all Participants agree to be bound by these terms and conditions, and Hyundai’s decision regarding any issue with the Competition will be final and binding and no correspondence will be entered into.
9. No responsibility will be accepted by Hyundai for any entry that is not delivered, received or is delayed due to technical or other issues.

 

HOW TO ENTER

10. Entries are open from 31 January 2025 to 16 February 2025, inclusive of both days.
11. Individuals must fill out the online entry form that can be found on the Handicaps Network Africa (Pty) Ltd website www.handicaps.co.za.
12. Entries received after the closing date will not be considered. Entries that do not comply with the criteria as set out herein will not be considered.

 

PRIZES

13. Participants who comply with clause 12 above and also meet the requirements of clause 7 above will be eligible as finalists to win the following prizes:

13.1. First place: 1(one) new Hyundai Exter for a period of 12 month OR R15,000.00 subsidy towards your golf membership.
13.2. Second place: R15 000.00 (Fifteen Thousand Rand) contribution towards their golf club membership.

14. 5 (five) Finalists will be chosen and announced on 17 February 2025, at random, using a randomiser. Finalists chosen will participate in the Competition on 23 February 2025 to stand a chance to win the prizes described in clause 13 above.
15. The prizes are not exchangeable for cash and are not transferable. Winners must be able to present a valid ID and driver’s licence in order to take ownership of the new Hyundai Exter. A refusal or inability to provide proof of identity will disqualify the winner(s) and the prize will be forfeited at the sole discretion of the Organisers.
16. The Organisers reserve the right to change any of the prizes without notice to the public, should they deem it necessary and for whatsoever reason, to a prize of similar economic value.
17. The Participants specifically warrant that they will have no claim against the Organisers in respect of any forfeited prize.
18. In the event that any or all Participants and/or finalists are not eligible to win either of the prizes as set out herein, Participants and/or finalists will forfeit the prize and the Organisers will, at their sole discretion, have no obligation to choose alternative Participants and/or finalists and/or winners. The Organisers reserve the right to change/amend the number of finalists at their sole discretion and without notice.

 

PUBLICITY AND DATA PRIVACY

19. By entering the Competition, a Participant acknowledges that personal information about the Participant will be shared with the Organisers and their agents to the extent necessary to conduct the Competition and for the prize to be delivered to prize winner.
20. The Organisers reserve the right to request that images be taken of the winner to be used for publicity and advertising purposes, without any further remuneration being made payable to the winner, and which request the winner may decline.
21. All personal information relating to the Participants will be used solely for the purpose of this Competition and in accordance with South African data protection legislation.
22. Participants understand and acknowledge that the Hyundai Open, including this Competition, is aired on live television, and by participating in this Competition they consent to their participation and progress being publicised and may be used by the Organisers in the future for further advertising on any of their public, social and/or other media and/or online platforms.
23. Participants understand and acknowledge that this Competition will be documented by the Organisers by means of live feeds, pictures, videos, recordings and the like on various public, social and/or other media and/or online platforms and the Organisers will retain such material in its advertising and marketing material and on any public, social and/or media and/or online platform as it sees fit for the promotion and furtherance of the business.
24. Participants understand and agree that they will have no entitlement to royalties of the Organisers whatsoever, payment for pictures, videos, live feeds, recordings and the like captured of their participation of the Competition or profits made by Organisers, public exposure or otherwise emanating from the pictures of Participants that are used as aforesaid and the Participants hereby waive all claims for same and indemnify the Organisers from such claim now and in future.
25. Participants acknowledge that if at any time they wish to retract their consent given in clauses 19 – 24 above, they are expected to provide written notice of this to the Organisers, who agrees not to use such material on their public or social media platforms upon receipt of such notice.

 

GENERAL

26. The Organisers reserve the right to shorten, extend, suspend the time period of the Competition or terminate the Competition without having chosen a winner/s whenever it should so choose for technical, commercial, or operational reasons, or for reasons beyond its control or generally for any reason whatsoever within their sole discretion. In such an event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they will have no right or recourse against the Organisers whatsoever in this regard.
27. The Participant waives any right which she/he may have against the Organisers as a result of such cancellation, suspension or termination of the Competition and completely indemnifies the Organisers from any claim arising therefrom.
28. To the fullest extent permitted by law, by participating, the Participant indemnifies, releases and agrees to hold harmless the Organisers, their associated, holding and subsidiary companies, and its directors, officers, agents, representatives, shareholders, employees, successors and assigns from any and all claims or liability arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of any prize.
29. The Organisers are not liable for any technical failures affecting entry and/or participation in the Competition and they assume no liability in this regard.
30. To the extent permitted by law, the Organisers will not be liable in any way whatsoever, for any claims arising from loss, injury, damage, harm, death or costs, suffered by a Participant in relation to this Competition or the prize offered, including but not limited to claims relating to defects in the prize or any losses caused by such defects or losses arising from inaccurate information supplied by Participants. Participants enter the Competition at their own risk.
31. South African law shall govern these Competition terms and conditions and the Courts of South Africa shall have jurisdiction.
